Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Unvios, operated by Subtilprofit Unipessoal Lda ("Unvios", "we", "us") in Portugal. By creating an account, listing an item, or completing a purchase, you agree to these Terms and our Privacy Policy and Cookie Policy.

If you use Unvios on behalf of a company, you represent that you have authority to bind that entity. Consumers retain mandatory rights under Portuguese and EU law that cannot be waived by contract.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering contracts.
  • You must provide accurate registration information and keep it updated.
  • You must not be barred from using payment services or marketplaces under applicable sanctions or fraud lists.
  • Business sellers must comply with tax, invoicing, and consumer information duties applicable to them.

3. Nature of the Platform

Unvios is an online marketplace connecting buyers and sellers of premium used technology. Except where we explicitly state otherwise, Unvios is not the seller of listed goods. We provide tools for listings, AI-assisted descriptions, payment authorisation through Stripe, and escrow-style fund holding until buyer confirmation.

We do not guarantee that a buyer or seller will complete a transaction, that an item will meet every subjective expectation, or that users are who they claim to be beyond reasonable verification steps we may implement.

4. Accounts and security

  • You are responsible for safeguarding your login credentials.
  • Notify us immediately at support@unvios.com if you suspect unauthorised access.
  • One person may not maintain multiple accounts to evade bans, fees, or limits.
  • We may suspend or terminate accounts that violate these Terms or pose risk to other users.

5. Listings and seller obligations

5.1 Accuracy

Sellers must upload their own photos, describe items honestly (condition, defects, battery health, activation locks, etc.), and set a fair price. AI-generated titles and specs are suggestions only — you are responsible for the published listing.

5.2 Permitted items

  • Premium technology: laptops, phones, tablets, cameras, pro audio, workstations, select e-mobility.
  • Minimum estimated resale value €80 in the Portuguese second-hand market.
  • Items must be legally owned and free of liens.

5.3 Prohibited items and content

  • Counterfeit, stolen, or serial-number-blocked devices.
  • Weapons, drugs, or any illegal goods.
  • Low-value accessories-only listings (cables, generic cases) and obsolete junk inventory.
  • Listings designed to circumvent quality or category rules.

5.4 Shipping

Sellers must ship within 3 business days after payment authorisation unless otherwise stated, using tracked shipping where available, and pack items securely. Provide tracking to the buyer through the Platform when the feature is available, or via support.

6. Buying on Unvios

  • Review listing details, photos, and seller reputation before paying.
  • Complete checkout via Stripe — off-platform payment requests are a violation of these Terms.
  • Inspect the item within 48 hours after carrier delivery and report material misdescription promptly.
  • Confirm receipt only when the item matches the listing in all material respects.

7. Fees and pricing

Fees are displayed before you confirm payment:

  • Buyer — item price, shipping (InPost locker or CTT Express), and Unvios Trust Shield (€2.50 + 2% of item price).
  • Seller — platform commission approximately 8% of item price, deducted when escrow funds are released.

We may change fee structures with at least 14 days' notice on the Platform. Transactions already in progress use the fees shown at checkout.

8. Payments and Unvios Escrow

Payments are processed by Stripe. When you pay, your payment method is authorised; capture to the seller occurs after you confirm delivery or after the inspection period expires without a valid dispute, subject to our procedures.

  • Authorised — funds held; seller should ship.
  • Escrow — awaiting buyer confirmation or dispute resolution.
  • Completed — funds captured; seller payout initiated per Stripe Connect rollout.
  • Disputed — release paused while we review evidence.

Chargebacks initiated with your bank without contacting us first may result in account suspension pending investigation.

9. Cancellations and refunds

  • Before shipment — buyer may cancel with full refund if seller has not shipped; seller may cancel with buyer refund if unable to fulfil.
  • After shipment — refunds follow dispute outcome and consumer law where you qualify as a consumer buying from a trader.
  • Trust Shield fee may be non-refundable once escrow services have been performed, except where required by law.

10. Disputes

Contact support@unvios.com with order ID, photos, and a clear description within the inspection window. We may request return shipment or expert assessment. Our decision on escrow release is based on listing evidence, tracking, and communications — we are not arbitrary arbiters of subjective preference (e.g. colour taste) unless the listing was misleading.

11. Intellectual property

Unvios branding, software, and content we create are owned by Subtilprofit Unipessoal Lda or licensors. You receive a limited licence to use the Platform for personal marketplace purposes. By posting content you grant Unvios a worldwide, non-exclusive licence to host, display, and process it for operating the service (including AI analysis).

12. Prohibited conduct

  • Fraud, phishing, money laundering, or sanctions evasion.
  • Circumventing fees by completing sales off-platform after matching on Unvios.
  • Scraping, reverse engineering, or overloading systems.
  • Harassment, hate speech, or impersonation.
  • Uploading malware or unlawful content.

13. Disclaimer of warranties

The Platform is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

14. Limitation of liability

To the maximum extent permitted by Portuguese law, Unvios and its directors, employees, and partners are not liable for indirect, incidental, special, or consequential damages, including lost profits or data. Our total liability for any claim arising from these Terms or the Platform is limited to the greater of (a) fees you paid to Unvios in the 12 months before the claim, or (b) €100, except where liability cannot be limited (death or personal injury caused by our negligence, fraud, or mandatory consumer rights).

15. Indemnity

You agree to indemnify Unvios against claims arising from your listings, sales, purchases, breach of these Terms, or violation of third-party rights, except where caused by our own breach or negligence.

16. Termination

You may stop using Unvios at any time. We may suspend or terminate access immediately for breach, risk, or legal requirement. Sections that by nature should survive (fees owed, disputes, liability, indemnity, governing law) remain in force.

17. Governing law and jurisdiction

These Terms are governed by the laws of Portugal. Courts in the district of Lisbon have jurisdiction for business users. Consumers resident in Portugal or the EU may bring proceedings in their place of residence where mandatory consumer rules allow.
